Welcome to the website of Transfer Warehouse (“we,” “us,” or “our”), a Federal Firearms Licensee (FFL) operating in Arizona. Our physical location is 13812 W Glendale Ave #2, Glendale, AZ 85307. These Terms of Service (“Terms”) govern your access to and use of our website at. https://www.transferwhs.com/ (the “Site”), including any services we provide such as firearm transfers, sales of firearms and National Firearms Act (NFA) items, inquiries, and related communications.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not access or use the Site.

1. Eligibility and Age Restrictions

You must be at least 18 years old to use the Site for long guns or 21 years old for handguns and certain other firearms, in accordance with federal law (Gun Control Act). You represent and warrant that:

You are not prohibited from purchasing, possessing, or receiving firearms or ammunition under federal, state, or local law.

You are a U.S. person and not located in or a national of any country subject to U.S. embargoes or sanctions.

You are not on any U.S. government prohibited or restricted parties lists.

We reserve the right to refuse service, terminate accounts, or cancel transactions if we suspect a violation of these requirements or any applicable law.

2. Services Offered

Transfer Warehouse provides FFL transfer services for firearms and NFA items (e.g., suppressors, short-barreled rifles, machine guns) purchased from third-party sellers, as well as direct sales of firearms and regulated items where permitted. All firearm-related transactions are subject to strict compliance with federal (ATF), state, and local laws.

Important: Firearms and NFA items cannot be shipped directly to individuals. They must be transferred through a licensed FFL dealer, including our facility, with completion of ATF Form 4473 (where required), a National Instant Criminal Background Check System (NICS) check, and any applicable waiting periods or state requirements. NFA transfers additionally require ATF approval (e.g., Form 4) and payment of any applicable tax stamp.

We reserve the right to refuse any transfer or sale for any reason, including but not limited to legal restrictions, safety concerns, or failure to comply with identification or documentation requirements.

3. User Accounts and Communications

You may need to create an account or provide contact information (name, address, phone, email) to use certain features. You are responsible for maintaining the confidentiality of your account and for all activities under it.

By providing your phone number, you consent to receive communications from us, including SMS/text messages for transactional purposes (e.g., transfer status, appointments). Marketing SMS requires separate prior express written consent and is governed by our Privacy Policy and the Telephone Consumer Protection Act (TCPA). Reply “STOP” to opt out of SMS at any time.

4. Firearm Transfers and Sales Process

All transfers and sales are conditional and contingent upon successful completion of required background checks, ATF approvals (for NFA), and verification that the transferee is not prohibited from possessing firearms.

You are solely responsible for ensuring compliance with all laws in your jurisdiction. We do not provide legal advice.

Transfer fees, NFA processing fees, and any storage fees (if applicable) will be clearly disclosed during the process.

Items not picked up within a reasonable time (typically 30 days) may incur storage fees or, after further notice, be considered abandoned in. accordance with applicable law.

We do not inspect, test-fire, or warrant the mechanical condition of transferred firearms beyond what is required by law. Any issues with the Item are between you and the original seller/shipper.

We comply with all ATF record-keeping requirements, including retention of Form 4473 and NFA paperwork for the periods mandated by federal law.

5. Prohibited Conduct

You agree not to:

Use the Site for any illegal purpose or to facilitate violations of firearms laws.

Provide false or misleading information.

Attempt to circumvent age, eligibility, or jurisdictional restrictions.

Interfere with the Site’s security or functionality.

Engage in any activity that could expose us to legal liability.

6. Intellectual Property

All content on the Site, including text, images, logos, and software, is owned by Transfer Warehouse or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any content without our prior written consent.

7. Disclaimers and Limitations of Liability

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We are not responsible for:

Delays or denials caused by ATF, NICS, or law enforcement.

Actions of third-party sellers or shippers.

Any firearm’s performance, safety, or legality in your possession.

Damages arising from your use of the Site or services, to the maximum extent permitted by law.

In no event shall Transfer Warehouse, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Transfer Warehouse and its affiliates from any claims, losses, liabilities, damages, and expenses (including attorney’s fees) arising from your use of the Site, violation of these Terms, or violation of any law.

9. Termination

We may terminate or suspend your access to the Site at any time, with or without cause or notice, particularly if we believe you have violated these Terms or applicable law.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

You agree to waive any right to a jury trial in any legal proceeding arising from these Terms.

11. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with a new effective date. Your continued use of the Site after changes constitutes acceptance of the updated Terms. Material changes will be notified where required by law.

12. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
